TERMOS DE SERVIÇO — FINNGIFTS SAUNAS

Bem-vindo(a) à Finngifts! Estes Termos de Serviço (“Termos”) regem o uso do nosso site, loja online, produtos e serviços relacionados à fabricação e venda de saunas finlandesas produzidas artesanalmente em São Paulo.

Ao acessar nosso site ou comprar qualquer produto, você concorda com estes Termos e com nossa Política de Privacidade.

1. SOBRE A FINNGIFTS

A Finngifts é uma empresa especializada na construção de saunas elétricas plug-and-play, inspiradas na tradição finlandesa.
Todos os produtos são projetados e fabricados manualmente por um artesão e carpinteiro finlandês com:

  • 17 anos de experiência em construção

  • Experiência vitalícia com sauna finlandesa e cultura de sauna

Por ser um ateliê de produção própria, oferecemos soluções funcionais, duráveis e mais acessíveis do que concorrentes maiores.

2. ACEITAÇÃO DOS TERMOS

Ao usar nosso site, fazer um pedido ou interagir com nossos serviços, você concorda com:

  • Nossa Política de Reembolso e Entrega

Se você não concorda, não deverá utilizar nosso site.

3. ELEGIBILIDADE E CADASTRO

Para comprar na Finngifts, você deve:

  • Ter idade mínima legal no Brasil ou autorização de um responsável

  • Fornecer informações verdadeiras, completas e atualizadas

  • Garantir a segurança das credenciais da sua conta (quando aplicável)

4. NATUREZA DOS PRODUTOS

Nossos produtos:

  • São construídos artesanalmente

  • São peças de grande porte

  • Podem apresentar pequenas variações naturais em madeira, tonalidade e textura

  • São fabricados sob demanda (sob encomenda)

Saunas são produtos personalizados, medidas e acabamentos podem variar conforme disponibilidade e adaptação técnica.

5. TIPOS DE PRODUTOS

A Finngifts oferece:

  • Saunas elétricas plug-and-play (110V ou 220V)

  • Modelos internos e externos

  • Modelos padrão pré-desenvolvidos

  • Projetos personalizados sob medida

  • Acessórios opcionais (bancos, iluminação, etc.)

6. FUNCIONAMENTO “PLUG-AND-PLAY”

Nossas saunas são projetadas para instalação simples:

  • Basta conectar à tomada compatível

  • Instalação elétrica deve estar em conformidade com a norma NBR 5410

  • Recomendamos avaliação de um eletricista qualificado

7. PRAZOS DE PRODUÇÃO

Por serem artesanais, os prazos de produção variam:

  • Produtos padrão: 10–30 dias úteis

  • Projetos personalizados: 15–45 dias úteis

O prazo começa após confirmação do pagamento.

Eventuais atrasos por motivos externos serão comunicados ao cliente.

8. PREÇOS E PAGAMENTO

Os valores exibidos:

  • Podem mudar sem aviso prévio

  • Podem variar conforme materiais e complexidade

  • Não incluem entrega (frete negociado separadamente)

Aceitamos:

  • Cartão

  • PIX

  • Parcelamento Shopify/MP (quando disponível)

9. FRETE E ENTREGA (IMPORTANTE)

Devido ao tamanho das saunas, não é possível fornecer um frete automático ou preço fixo.

Portanto:

  • O frete é combinado individualmente após a compra

  • O custo será baseado em endereço, acesso ao local, tamanho da sauna

  • Pode ser entregue pela Finngifts ou por transportadora parceira

O cliente será consultado antes de confirmar a entrega.

10. RISCO, TRANSPORTE E RECEBIMENTO

Após o envio:

  • A responsabilidade é transferida para o cliente

  • Danos ocorridos durante transporte são de responsabilidade da transportadora

  • Na entrega, o cliente deve verificar o produto antes de assinar o recebimento

11. GARANTIA

Oferecemos garantia limitada de:

  • 12 meses para estrutura

  • 6 meses para componentes elétricos (resistências, controladores, etc.)

A garantia não cobre:

  • Mau uso

  • Instalação elétrica inadequada

  • Infiltrações externas

  • Modificações não autorizadas

  • Danos causados por terceiros

12. DIREITO DE ARREPENDIMENTO (CDC)

Saunas são produtos especiais, personalizados e fabricados sob encomenda, portanto não se aplicam ao direito de arrependimento de 7 dias (art. 49 do CDC).

Trocas e ajustes podem ser negociados caso haja erro comprovado de fabricação.

13. LIMITAÇÃO DE RESPONSABILIDADE

A Finngifts não se responsabiliza por:

  • Danos causados por instalação inadequada

  • Uso incorreto do equipamento

  • Problemas elétricos externos

  • Modificações feitas pelo cliente

  • Acidentes decorrentes de mau uso

O cliente concorda em usar a sauna conforme orientações fornecidas.

14. PROPRIEDADE INTELECTUAL

Todos os textos, imagens, logos, designs e conteúdos do site são propriedade da Finngifts.
É proibido copiar, reproduzir ou usar comercialmente sem autorização.

15. USOS PROIBIDOS

Você não pode:

  • Usar o site para fins ilegais

  • Falsificar informações

  • Violar direitos autorais

  • Enviar malware

  • Utilizar o site para práticas abusivas

16. LINKS DE TERCEIROS

O site pode conter links externos. Não nos responsabilizamos por conteúdos de terceiros.

17. FERRAMENTAS DE TERCEIROS

Shopify e outras ferramentas são usadas para processar pagamentos e operar a loja.
O uso delas segue os respectivos termos das plataformas.

Este contrato é regido pelas leis brasileiras, especialmente:

Welcome to Finngifts. These Terms of Service (“Terms”, “Terms of Service”) govern your use of our website, store, products and services (collectively, the “Services”). The terms “we”, “us”, and “our” refer to Finngifts Sauna Nórdica Tradicional, located in São Paulo, Brazil, operating as a small artisan business specializing in the construction of authentic Finnish-style electric saunas.

By accessing or purchasing from our website, you agree to these Terms and to our Privacy Policy. If you do not agree, please discontinue use of our Services.

SECTION 1 – ABOUT FINNGIFTS

Finngifts is a Finnish-owned artisan business specializing in custom-built Nordic electric saunas, designed, manufactured, and assembled in São Paulo, Brazil.
All saunas are produced by the founder, a Finnish carpenter with 17 years of construction experience and a lifelong understanding of Finnish sauna culture, materials, ergonomics, and thermal behavior.

As a small independent company, Finngifts provides high-quality, durable, health-conscious, and cost-efficient sauna solutions, with plug-and-play installation whenever possible.

SECTION 2 – ACCEPTANCE OF TERMS

By using our Services, you confirm that:

  1. You are at least 18 years old.

  2. You have legal authority to enter into this agreement.

  3. The information provided for orders, billing, and delivery is accurate.

You agree that Finngifts may update these Terms at any time. Continued use of our Services after updates constitutes acceptance of revised Terms.

SECTION 3 – OUR PRODUCTS AND SERVICES

Finngifts builds:

  • Indoor and outdoor electric saunas

  • Plug-and-play sauna cabins (ready-to-use; only require electrical connection)

  • Semi-custom and fully custom sauna models

  • Wood finishing, paneling, and interior sauna components

Important Notice

All Finngifts saunas are handcrafted, and minor variations in material color, grain, texture, and finish are natural characteristics of wood-based products.

Due to custom manufacturing, product descriptions, dimensions, and visual representations may vary slightly from final delivered products.

SECTION 4 – CUSTOM ORDERS

Most saunas we sell are made-to-order.
When you place a custom order, you acknowledge that:

  1. Production begins only after payment confirmation.

  2. Modifications after work has started may incur additional costs.

  3. Custom products cannot be returned unless defective, as permitted by Brazilian consumer law (CDC).

  4. Construction timelines depend on complexity, availability of materials, and weather conditions (in case of outdoor structures).

SECTION 5 – PRICING AND PAYMENT

Prices are listed in BRL (Brazilian Real) unless stated otherwise. Prices may change without prior notice.

Payments

We accept payments through Shopify payment processors and may require:

  • Full payment

  • Partial deposit + final payment

  • Payment in installments via available methods

You agree to provide accurate billing and payment information.

Taxes & Fees

Published prices may exclude:

  • Shipping

  • Delivery logistics

  • Installation (if applicable)

  • Electrical modifications at the client's property

Any additional charges will be communicated before order confirmation.

SECTION 6 – SHIPPING, DELIVERY & INSTALLATION

6.1 Delivery Cost

Due to the large size and weight of sauna cabins, shipping costs cannot be standardized.
Therefore:

All delivery fees are calculated individually based on the delivery address and agreed directly with the client.

The customer is responsible for providing correct access details (elevators, gates, restricted streets, stairs, etc.).

6.2 Delivery Conditions

Once the sauna is handed to the carrier or delivery provider, risk of loss transfers to the customer, except where prohibited by Brazilian law.

6.3 Plug-and-Play saunas

Most Finngifts saunas require only:

  • A dedicated power outlet (110V or 220V depending on model)

  • Adequate ventilation

  • Sufficient clearance around the sauna

It is the customer's responsibility to ensure that electrical conditions are compatible.

Finngifts is not responsible for any electrical infrastructure issues at the customer's property.

6.4 Installation Services

If installation is included, the client must provide a safe work environment.

We may refuse installation if the location is unsafe or unsuitable.

SECTION 7 – RETURNS, EXCHANGES & WARRANTY

7.1 Returns

Because saunas are custom products, Finngifts does not accept returns or cancellations after production begins, except when required by the Brazilian Código de Defesa do Consumidor.

7.2 Manufacturing Warranty

We provide warranty against:

  • Structural defects

  • Manufacturing errors

  • Faulty assembly

Warranty does not cover:

  • Damage caused by improper use

  • Exposure to rain (unless the sauna is an outdoor model)

  • Electrical installations performed by third parties

  • Unauthorized modifications

  • Mold caused by poor ventilation or misuse

SECTION 8 – PRODUCT DISCLAIMER

Saunas involve heat, electricity, and humidity, which require responsible use.

Finngifts is not liable for:

  • Health issues caused by improper sauna use

  • Damage resulting from misuse

  • Electrical problems caused by external installations

  • Long-term neglect or lack of maintenance by the customer

Clients must follow all usage and safety instructions provided in the manual.

SECTION 9 – WEBSITE USE

You agree not to:

  • Use the website for illegal activity

  • Attempt to harm, hack, or disrupt our Services

  • Copy or republish images, text, or product designs without permission

All content is the property of Finngifts and protected by Brazilian and international copyright laws.

SECTION 10 – INTELLECTUAL PROPERTY

All logos, images (including the Finngifts Bear Sauna logo), texts, illustrations, and product designs are owned by Finngifts.

You may not copy, modify, reproduce, or resell any content or product design without written permission.

SECTION 11 – THIRD-PARTY TOOLS & LINKS

Finngifts may use third-party apps, plugins, and services (e.g., Shopify Payments, shipping APIs).

We are not responsible for:

  • Content hosted by third parties

  • Errors caused by third-party integrations

  • The privacy practices of external websites

Use them at your own discretion.

SECTION 12 – LIMITATION OF LIABILITY

To the fullest extent permitted by Brazilian law:

Finngifts is not liable for:

  • Indirect losses

  • Lost revenue

  • Business interruption

  • Damages caused by misuse or incorrect installation

  • Delays due to carriers or force majeure events

Our maximum liability will never exceed the value paid for the product in question.

SECTION 13 – INDEMNIFICATION

You agree to indemnify and hold harmless Finngifts and its members from claims arising from:

  • Misuse of the sauna

  • Breach of these Terms

  • Improper installation by third parties

SECTION 14 – SEVERABILITY

If any part of these Terms is deemed invalid, the remaining sections remain enforceable.

SECTION 15 – TERMINATION

We may terminate Services for:

  • Fraud

  • Abuse

  • Violation of these Terms

Your obligations and any outstanding payments still apply.

SECTION 16 – GOVERNING LAW (BRAZIL)

These Terms are governed by the laws of Brazil, particularly the Código de Defesa do Consumidor.

Any disputes shall be resolved in the courts of São Paulo – SP.
